NHPC Warns Against Use of Unregistered Persons in Health Services

The Nepal Health Professional Council (NHPC), based in Bansbari, Kathmandu, has stated that it has taken serious notice of rising complaints that health services are being delivered by persons who are not registered with the Council.
Issuing a public notice on 2082/12/23, the Council gave a strong warning to all concerned not to carry out or allow such unlawful practices.
According to the Council, complaints have been received from various individuals and organizations that unregistered persons have been involved in health treatment and profession-related activities in different hospitals and health institutions, especially in many dental hospitals and dental clinics, laboratories, and diagnostic centers.
The notice states that such unauthorized persons have been engaged in activities including taking X-rays, cutting teeth, taking dental impressions, drawing blood, and similar work. The Council has also directed that unlawful practices such as requiring a health professional registered in one discipline to perform work of another discipline must be stopped immediately.
Legal Basis
The notice recalls the legal provisions of the Nepal Health Professional Council Act, 2053.
According to the notice, various sub-sections under Section 2 of the Act clearly define “health profession,” a “health professional” who has obtained the prescribed minimum qualification, and a “registered health professional” whose name is entered in the registration book.
The Council has particularly clarified that Section 20 of the Act clearly provides that no person other than a registered health professional may engage, directly or indirectly, in health professional practice.
Warning and Direction
The Council has warned that if such acts are carried out in disregard of the prescribed law and direction, the process of necessary legal action will be initiated in accordance with Sections 20 and 28 of the Nepal Health Professional Council Act, 2053, and the Nepal Health Professional Council Rules, 2056, including fines.
The Council has also requested health professionals whose names are registered with the Council to carry out their work in full compliance with the Code of Ethics issued by the Council.
