Education and Sports Ministry Removes Section Officer Shyamala Paudel from Service
The Government of Nepal, Ministry of Education and Sports, has removed Section Officer Shyamala Paudel, Employee ID No. 194084, from service in a manner that does not disqualify her from government service in the future. The Ministry stated through a notice that she was removed from service effective from 2083/2/29 for remaining absent from office for more than 90 (ninety) consecutive days without approved leave.
According to the Ministry, after Paudel was found continuously absent, she was asked to submit a clarification within 35 (thirty-five) days pursuant to Section 66(1) of the Civil Service Act, 2049. As the clarification submitted by her was not found satisfactory, she was again asked, pursuant to Section 67 of the Act, to submit an explanation within 35 days if she had any evidence, proof, or reason as to why the punishment under Section 59(b)(1) of the Act should not be imposed for the offense under Section 61(1)(f) of the Act. The Ministry stated that even in that explanation, she did not provide a reasonable ground for her absence.
After considering the documents collected in this regard, the evidence obtained, and the explanation submitted, the Ministry proceeded with action, concluding that she had committed the offense under Section 61(1)(f) of the Act by remaining absent from office for 90 consecutive days without approved leave.
The punishment under Section 59(b)(1) of the Act was proposed, and as consultation was received from the Central Office of the Public Service Commission, Kamalpokhari, for imposing the said punishment, the decision was made to remove her from service without disqualifying her from government service in the future.
The notice published by the Ministry has also informed that if she is not satisfied with the decision, she may file an appeal before the authority hearing appeals within the time limit prescribed under Rule 114(d).
