Preparation to Dismiss 11 Scientific and Technical Staff Who Did Not Return After Study Leave; Notice to Appear Within 15 Days

The Nepal Agricultural Research Council (NARC) has initiated a process to remove 11 of its permanent employees from service after they failed to return to work within the prescribed time following study leave and remained out of contact. Issuing a second “highly urgent” notice today, the Council has instructed the concerned employees to appear within 15 days with a written clarification.

According to the notice, these employees had taken study leave after obtaining approval and signing a bond (kabuliatnama) pursuant to Regulation 38 of the Council’s Employee Administration Regulations, 2049, but did not report back after completing their studies. Instead of returning, they remained absent and submitted resignations while still absent, and did not remain in contact with the Council. The Council has concluded that they breached the conditions of the bond.

Key Points of the Notice

• Violation of service conditions: The employees violated the condition requiring them to return to the Council’s service after completing their studies. By sending resignations while remaining absent, their service will be deemed terminated under Regulation 40(2)(a).

• Recovery of investment: In accordance with Regulation 38(4), the Council has decided to recover the entire investment made in the employees during the period of study.

• Non-compliance with the previous notice: Earlier, on 2082/08/14, a notice was published in Gorkhapatra with a 7-day deadline, but the concerned employees did not appear.

• Dismissal process initiated: As per the decision of the Council’s 66th meeting held on 2081/03/31, the process to remove the concerned employees from service has been initiated.

• Final opportunity: The concerned employees have been instructed to appear with clarification within 15 days from the date of publication of this notice for the purpose of Regulation 63(1). If they fail to do so, they will be dismissed as per the Council’s regulations.
