Rabilamichhane and Salikram Pudasaini Case

What is Encouraged to Commit Suicide?

One of the new provisions of the Civil Crime Code, which has been in force since September last year, is the punishment for those who commit suicide. Article 185 of the Code states, "No one should be encouraged or encouraged to commit suicide or to create a situation for doing so."

There is a provision of imprisonment for up to five years and a fine up to Rs. Fifty thousand. Such arrangement is already in place in India, including in neighboring India. In Nepal, such a law has only recently been made and the Supreme Court has not rendered it. Therefore, It has the dilemma of what events should be considered suicide attacks and which do not. TV show presenter Rabi Lamichhane was arrested on charges of abetting suicide case of Shalikram Pudasaini.

"If one commits suicide as a result of doing what is right, then it is not abusive," said senior advocate Shambhu Thapa.

But if someone's misconduct leads to suicide, that is discouraging. ' He said that if someone threatens, bargained, or commits suicide by doing anything that violates someone's privacy, he can be accused of abusive behavior. But if he brings out the facts, publishes some truth news in the magazine or does any of the tasks he is responsible for, he says that if he commits suicide, then that should not be encouraged.

A Subba recently committed suicide when authorities tried the case. The authority cannot be blamed, "he said," because it is his job to prosecute. But if someone goes without bargaining or kidnapping a secret, he is accused of committing suicide in such a case if he goes to bargaining and gives a hint of harm.

He said that abuse should be misinterpreted as he should be careful about this.

For the purpose of eliminating the ambiguity contained in it, the Office of the Attorney General had prepared a 'study report on the necessity of declaring a criminal a criminal who commits suicide.'

Initial investigations suggest that if the victim was forced to commit suicide, the accused should be arrested and taken to the deposition and the accused should be punished if the false witness was found. Reports made by the Task Force before the implementation of the Criminal Code also point out that abuse of the abusive provisions in suicide may be misused.

"In such cases, the victim who is the most ego witnesses the death of himself, thus increasing the probability of malicious prosecution," the report said. The report indicates that the provision regarding abusive family abuse and other abuses may be misused.

According to the study, the report states that the penalties of abuse can be misused due to coverings of the deceased, bargaining with accused parties for some unfair gains, making false statements in public, directed by the crowd and taking advantage of unscientific investigation. The report stresses that the government should implement the law only after extensive discussion.
