Strict Standards for Foreign-Affiliated Colleges: ‘Foreign Educational Program Rules, 2083’ Approved

The Government of Nepal has approved the “Foreign Educational Program (Operation and Regulation) Rules, 2083” to improve the quality and make regulation more effective for colleges operating under foreign affiliation. The Rules prepared by the Ministry of Education and Sports were approved by the Cabinet meeting held on Wednesday. (Department of Printing)

With these Rules, introduced with the objective of enhancing the quality, credibility, and international competitiveness of higher education, stricter standards will apply to colleges operating in Nepal under affiliation with foreign universities. According to available data, 56 foreign university-affiliated colleges and courses in Nepal are currently in operation.

The main provisions made in the new Rules are as follows:

Standards Related to World Ranking and QAA

• The foreign university granting affiliation must have applied for five consecutive years in the world ranking of Times Higher Education or QS Ranking and must have been ranked within the top 1,000 at least once.

• The 49 colleges currently in operation must also submit proof of the stated world ranking within three years. If they fail to submit the proof within the prescribed period, the operating permission of such teaching institutions will be cancelled.

• Colleges must have obtained two-stage Quality Assurance and Accreditation (QAA) from the concerned country and Nepal’s University Grants Commission. If operating colleges do not obtain QAA within three years and newly permitted colleges do not obtain QAA within five years, their permission will be automatically cancelled.

Deposit Amount and Limit on Affiliation

• Colleges must deposit Rs. 2.5 million for the postgraduate level and Rs. 3.5 million for the bachelor’s level. For an additional program at the same level, an additional amount equal to half of the prescribed deposit, or 50 percent, must be deposited. Earlier, there was a provision allowing a maximum deposit of up to Rs. 3 million depending on the course.

• Under the new standards, one college will not be allowed to operate academic programs by taking affiliation from more than one university. If a college is operating programs from more than one university, it must choose only one within five years from the issuance of the Rules.

Student Number, Admission, and Scholarship

• Teaching may not be conducted with more than 30 students in one class or room, even if the university has prescribed more students than that.

• According to the academic calendar, student admission may not be taken more than twice in one academic session.

• If the college has foreign investment, full scholarships must be provided to 20 percent of students, and if it has domestic investment, full scholarships must be provided to 10 percent of students.

• Although teaching is conducted under a foreign curriculum, the subject “Nepal Studies” must be taught compulsorily to help students understand Nepal’s identity, originality, and culture.

• A provision has been introduced that students may not transfer more than 40 percent of the curriculum through Credit Transfer to a foreign university.

Physical Infrastructure and Land Provisions

• Foreign colleges must have land and buildings under their own ownership. Newly permitted colleges must construct buildings on land under their own ownership within five years, and colleges currently in operation must do so within 10 years.

• For this purpose, colleges operating in the Kathmandu Valley must have at least 3 ropani of land, those in the hills must have 6 ropani, and those in the Tarai must have 15 kattha.

Stakeholders’ Response

Laxman KC, President of the International Education Providers’ Association of Nepal (IEPAN), has stated that operating colleges have received further legal validity through the Rules and that they have taken it positively. However, he said that although they had suggested not making world ranking a standard for colleges and fixing at least 48 seats in a class, the Rules were not issued accordingly.

“There is no major disagreement with the other provisions of the Rules. The government is trying to regulate, and we are positive,” President KC said.

Although experts had suggested that foreign colleges should be operated under the University Grants Commission, the Rules have kept them under the Ministry of Education. The government is preparing to give colleges that cannot meet the prescribed standards a certain period for improvement and, if they fail to meet the standards within that period, not renew their affiliation, ban new admissions, or proceed with necessary legal action.
