Public Service Commission First Amendment Rules, 2082

Introduction and Commencement

  1. Short Title and Commencement:

    • These rules shall be called the "Public Service Commission (First Amendment) Rules, 2082."

    • They shall come into force immediately.

Amendment to Rule 23 of the Public Service Commission Rules, 2079

  1. Amendment to Rule 23 of the Public Service Commission Rules, 2079 (hereinafter referred to as "Original Rules"):

23A. Provisions Relating to Preliminary Examination:

  1. While conducting written examinations of organized institutions, the Commission may conduct a preliminary examination applicable to all or any one or more organized institutions by specifying the service, group or subgroup, and post, class, or level, or only the post, class, or level.

  2. The Commission shall approve and publish the syllabus required for the preliminary examination conducted under sub-rule (1).

  3. The preliminary examination conducted under sub-rule (1) shall be held as per the annual schedule of the Commission.

  4. Even if different services, groups, subgroups, academic qualifications, experience, skills, and designations are specified for the same class or level in various organized institutions, the minimum academic qualification for the preliminary examination to be conducted under this rule shall be:

    • Secondary Education Examination (SEE) or equivalent for Assistant Level Second Class, Kharidar or equivalent, or Fourth Level or equivalent;

    • Proficiency Certificate Level or Ten Plus Two or equivalent for Assistant Level First Class, Nayab Subba or equivalent, or Fifth Level or equivalent;

    • Bachelor’s Degree or equivalent for Officer Level Third Class, Section Officer or equivalent, or Sixth or Seventh Level or equivalent.

  5. The Commission may call for applications for the preliminary examination conducted under sub-rule (1).

  6. The tasks of publishing notice, collecting applications, approving applications, conducting examination, and publishing results shall be performed by the Commission.

  7. A candidate applying for the preliminary examination under this rule shall submit the application form as per Schedule-4 along with the application fee as per Schedule-2.

  8. The Commission shall publish the results of the preliminary examination on its website, and those who pass the preliminary examination shall be provided with a certificate as per Schedule-4.

  9. A candidate who obtains a certificate as per sub-rule (8) may be deemed eligible to apply for a post of the relevant service, group, or subgroup, class, or level advertised by the related organized institution within one year from the date of issuance of the certificate.

    • However, candidates who do not meet the minimum qualification prescribed for the concerned post, class, or level as per the employee service rules or regulations of the related organized institution shall not be eligible to apply merely based on having passed the preliminary examination under this rule.

  10. A candidate applying for the preliminary examination shall meet the following qualifications:

(a) Must be a Nepali citizen;

(b) Must meet the academic qualification specified under sub-rule (4);

(c) Must have completed 18 years of age for the posts of Assistant Level Second Class, Kharidar or equivalent, or Fourth Level or equivalent and Assistant Level First Class, Nayab Subba or equivalent, or Fifth Level or equivalent;

(d) Must have completed 21 years of age for the posts of Officer Level Third Class, Section Officer or equivalent, or Sixth or Seventh Level or equivalent;

(e) The maximum age limit shall not exceed 35 years for male candidates and 40 years for female and disabled candidates;

(f) The age limit shall not apply to permanent employees serving in the organized institutions;

(g) Must not have been dismissed in a manner disqualifying for future governmental or institutional service;

(h) Must not have been convicted by a court of a criminal offense involving moral turpitude.

  1. Even if the organized institution has not requested the Commission for agreement for filling the posts, the Commission may conduct a preliminary examination for all or any one or more organized institutions for the post, class, or level specified by the Commission.

  2. The organized institution shall ensure that only candidates who have passed the preliminary examination conducted by the Commission for the specified post, class, or level may apply when publishing the advertisement for filling such posts.

  3. Regarding the preliminary examination of organized institutions, matters mentioned in this rule shall be governed by this rule, and matters not mentioned shall be governed by prevailing laws.

23B. Provisions Relating to Joint Examination of Organized Institutions:

  1. While conducting written examinations for organized institutions, the Commission may conduct the written examination of any or all papers jointly or separately for the same post, class, or level across two or more organized institutions.

  2. For the purpose of conducting examination under sub-rule (1), posts of the same class or level may be grouped considering the nature of work of the organized institutions.

  3. The Commission may conduct any paper jointly and others separately for the post, class, or level as per sub-rule (1).

  4. The curriculum for the examination conducted under this rule shall be as approved by the Commission.

  5. While publishing the results of the joint written examination conducted by the Commission:

    • (a) For centralized advertisements, results shall be published based on the total number of vacancies demanded by the centralized advertising organized institutions;

    • (b) For province-level advertisements, results shall be published based on the total number of vacancies demanded by the province-level advertising institutions;

    • (c) If the number of total vacancies is equal, the order shall be based on alphabetical order.

  6. When publishing the results of organized institutions in subsequent order, additional candidates shall be included in the result as per the number of candidates included in the result of the previous institution.

  7. Among the candidates selected for interviews from the joint written examination conducted under this rule, those who are not included in the recommendation merit list shall be included in the alternative merit list.

  8. Regarding joint examination of organized institutions, matters mentioned in this rule shall be governed by this rule, and matters not mentioned shall be governed by prevailing laws.

Amendments to the Schedule of the Original Rules:

  1. Amendments to the Schedule of the Original Rules:

  2. In Schedule-2, after the words "sub-rule (1) of Rule 19," the words "sub-rule (7) of Rule 23A" shall be inserted. Likewise, after serial number (6), the following serial number (7) shall be added:

    • (7) Application fees for the preliminary examination for posts of organized institutions:

      • NPR 200 for Assistant Level Second Class, Kharidar or equivalent, or Fourth Level or equivalent;

      • NPR 300 for Assistant Level First Class, Nayab Subba or equivalent, or Fifth Level or equivalent;

      • NPR 500 for Officer Level Third Class, Section Officer or equivalent, or Sixth or Seventh Level or equivalent.

  3. Schedule-4A and Schedule-4B as attached shall be added after Schedule-4.

  4. After Chapter 1 of Schedule-6, the following Chapter 1A shall be added:

    • 1A. Notwithstanding anything written in Chapter 1, while publishing the result of the joint written examination as per Rule 23B, the following number of additional passed candidates shall be added as per the number of vacant posts demanded:

      • If vacancies are 1 to 5: Add 5 candidates

      • If vacancies are 6 to 10: Add 6 candidates

      • If vacancies are 11 or more: Add candidates equal to 50% of total vacancies
